Welcome to the PlateThis application (the “App”) and the websites, products, and services owned or operated by Sidao Tech, LLC (the “Company,” “Sidao Tech, LLC,” “we,” “us,” or “our”) (collectively, “Sidao Tech, LLC Services”). By accessing or using Sidao Tech, LLC Services, you agree to be bound by these Terms of Use, including all supplemental guidelines and future amendments (collectively, the “Terms”).
These Terms constitute a legally binding agreement between you (the “User”) and the Company. The Services are currently intended for users located in the United States. The Services are intended for users who are at least 13 years old. If you are between 13 and 18, you may use the Services only with the involvement and supervision of a parent or legal guardian. By accessing, installing, or subscribing to the Services, you acknowledge that you have read, understood, and accepted these Terms.
Disclaimer and Assumption of Risk
The Services provide AI-generated cooking, food-recognition, scan-based identification, photo-based cooking coaching, recipe, cooking know-how, scenario-based coaching, situation-based coaching, technique-based coaching, ingredient-based coaching, cooking-tool, nutrition-estimation, ingredient-label recognition, preparation-status recognition, and cooking-safety information for informational purposes only. The Services do not constitute professional safety, medical, nutrition, or health advice, and do not replace adult supervision, professional judgment, food safety practices, or safe kitchen operation. You assume full responsibility for safety in your kitchen environment, including tool handling, knives, heat/source control, hot oil, gas, ovens, allergens, raw food, food-condition and package-date decisions, timer use, sauce-ratio decisions, and hygiene. Sidao Tech, LLC does not guarantee the accuracy or completeness of AI-generated content, recipe content, timers, food-date tracking, sauce-ratio tools, or other cooking tools. Your reliance on any information provided by the Services is at your own risk. To the maximum extent permitted by law, Sidao Tech, LLC is not responsible for losses, damages, or personal injuries resulting from a user’s failure to follow safety instructions, failure to verify safety-sensitive information, misuse of the Services, or reliance on the Services contrary to these warnings.

The Services are provided for general informational, educational, and culinary assistance purposes only. The Services do not provide medical advice, professional nutrition advice, professional dietary advice, or professional food-safety advice. You should consult qualified professionals where appropriate for your health, dietary, allergy, food-safety, or other personal circumstances.
Cooking know-how, Coach by Scenario, Coach by Situation, Coach by Technique, Coach by Ingredient, Scan Coach, recipe guidance, and cooking tools are all subject to these safety limitations. They are not a substitute for official food-safety guidance, package labels, food thermometers, professional advice, or emergency services.
AI-generated, scan-based, photo-based, coaching, recipe, cooking know-how, scenario-based, situation-based, technique-based, ingredient-based, cooking-tool, ingredient-label, preparation-status, protein, calorie, and nutrition-related outputs may be inaccurate, incomplete, outdated, or inappropriate for your specific ingredients, equipment, environment, health status, allergies, dietary restrictions, or cooking situation. You are responsible for reviewing, verifying, and deciding whether to rely on any output from the Services.
Scan Coach and preparation-status outputs cannot confirm safe doneness, safe handling, or readiness to eat. Protein and calorie outputs are estimates only and are not medical, weight-loss, fitness, or professional nutrition advice. Ingredient-label outputs are not a complete allergen check and must be confirmed against the original package. Ingredient recognition and recipe matching do not determine whether food is safe, fresh, uncontaminated, or suitable for a particular person. Food Date Tracker records printed dates and user-entered information; it does not determine freshness, spoilage, food quality, or whether food is safe to eat. Timers and sauce-ratio tools are convenience tools and do not replace active supervision, label directions, food thermometers, or safety checks.
You are solely responsible for kitchen safety, including safe handling, storage, preparation, and cooking of food; checking ingredient labels and package dates; identifying and managing allergens; preventing cross-contamination; using knives, appliances, heat, fire, hot surfaces, steam, and hot oil safely; and confirming that food is cooked to a safe internal temperature where applicable.
Do not use the Services to decide that food is safe after possible spoilage, off odors, unsafe storage, time-temperature abuse, cross-contamination, allergen exposure, raw or undercooked animal foods, unsafe leftovers, heavy smoke, fire, or uncontrolled hot oil. When safety is uncertain, follow official guidance, contact qualified professionals when appropriate, and discard food rather than relying on App output.
Sidao Tech, LLC does not guarantee any safety, health, nutritional, or food-quality outcome and does not assume responsibility for risks involving raw or undercooked meat, seafood, eggs, poultry, hot oil, fire, smoke, burns, cuts, allergic reactions, foodborne illness, choking, poisoning, equipment malfunction, or other kitchen hazards.
The Services are not intended for emergency use. In the event of fire, smoke, injury, suspected poisoning, severe allergic reaction, foodborne illness, or any medical, safety, or life-threatening situation, you should immediately contact appropriate emergency services, medical professionals, poison control, fire services, or other qualified authorities.
Children and minors must use the Services only with appropriate adult supervision. Adults are responsible for supervising any cooking, food handling, appliance use, knife use, heat exposure, and other kitchen activities involving children or minors.
2. AUTHORIZED USERS
Your use of the Services must comply with all applicable laws. The Services are not directed to children under 13. Users between 13 and 18 must use the Services only with parent or legal guardian supervision, especially when cooking involves knives, heat sources, hot oil, ovens, gas, allergens, raw or perishable foods, or other safety-sensitive conditions.
3. SPECIFIC FEATURES AND PRIVACY
Your use of the Services is also governed by our Privacy Policy, available at https://www.platethisai.com/privacy, and our Safety & Disclaimer. Feature-specific notices and safety instructions presented in the App are incorporated into these Terms by reference.
Account and Subscription Features: The current release may include user accounts and Apple-managed subscriptions or in-app purchases. Subscription billing, renewal, cancellation, refunds, and related payment administration are handled by Apple according to applicable App Store terms. You are responsible for managing your subscription through your Apple account. Additional terms are provided in the Subscription Terms displayed in the App.
4. AI FUNCTIONALITY
Third-Party Processing: We utilize third-party AI services to process data and generate personalized culinary guidance.
Photo Processing Choice: Before the first photo-based upload, the App asks you to authorize cloud and AI processing of the photos you choose. You may close the notice and continue without uploading, and you may withdraw authorization for future photo uploads in Settings.
System Limitations: AI-generated content may be inaccurate or incomplete. You must exercise your own judgment and verify the safety of cooking steps.
Photo Quality, Confirmation, and Safety Checks: The App may ask you to retake or supplement photos if images are blurry, too dark, unclear, repetitive, or missing key cooking details. The App may ask you to confirm dish names, ingredients, or cooking steps when user inputs and image information appear inconsistent. If the App identifies safety-sensitive conditions, including raw meat, raw fish, poultry doneness, high oil temperature, open flame, heavy smoke, burning, allergens, or similar risks, it may provide only conservative safety reminders instead of a definitive result.
5. USER-GENERATED CONTENT (UGC)
Processing: In the current Phase 1 U.S. market release, we process account information, subscription entitlement records, uploaded food and cooking photos, ingredient label photos, extracted label text, scan inputs, optional notes, user selections or confirmations, scan results, recipe interactions, cooking know-how interactions, scenario/situation/technique/ingredient coaching inputs, cooking-tool inputs such as timer settings, Food Date Tracker entries, and sauce-ratio values, estimated nutrition information, food-preparation status signals, allergen or food-safety risk signals, image-quality signals, and related metadata to provide user accounts, Apple-managed subscription access, the recipe library, Scan Coach photo-based cooking coaching, Protein & Calories ID, Ingredient Label ID, Prep ID, cooking know-how, Coach by Scenario, Coach by Situation, Coach by Technique, Coach by Ingredient, Cooking Tools, recipe recommendations, and safety/protection results.
Anonymization and Model Training: We do not currently use identifiable UGC or raw user uploads for offline model training, sale, or unrelated independent commercial purposes unless we update the applicable policy and obtain any required consent.
6. CONTENT COMPLIANCE
Prohibited content includes anything violating Apple App Store guidelines (e.g., pornography, hate speech, violence, or dangerous instructions). We reserve the right to delete such content and terminate accounts.
7. DATA SHARING (U.S. & CALIFORNIA RESIDENTS)
We do not sell Personal Data. For California residents, we will provide required privacy rights mechanisms, including opt-out mechanisms if our practices require them under applicable law.
8. OWNERSHIP AND INTELLECTUAL PROPERTY
All Sidao Tech, LLC materials (software, code, algorithms, designs, graphics) are the exclusive property of Sidao Tech, LLC and are protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only.
9. USE RESTRICTIONS
You agree not to
Interfere with the security or operation of the Services.
Use automated tools (robots, scrapers) to access the Services without permission.
Reverse engineer or attempt to extract the source code or algorithms.
Send unsolicited advertisements (spam) to other users.
10. USER CONTENT LICENSE
By uploading or submitting content, you grant Sidao Tech, LLC a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, and use your content only as reasonably necessary, and only for as long as reasonably necessary, to operate, provide, maintain, protect, support, and improve the Services, subject to our Privacy Policy. This license does not authorize the use of identifiable user uploads for unrelated advertising or independent commercial purposes.
11. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Sidao Tech, LLC from third-party claims, losses, liabilities, and reasonable expenses (including attorneys’ fees) arising from: (i) your intentional misuse of the Services; (ii) your material violation of these Terms; or (iii) your infringement of third-party rights.
12. LIMITATION OF LIABILITY
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. SIDAO TECH, LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, EXCEPT TO THE EXTENT A WARRANTY CANNOT LEGALLY BE DISCLAIMED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDAO TECH, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE SERVICES. SIDAO TECH, LLC’S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO SIDAO TECH, LLC THROUGH THE APP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, THESE LIMITATIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW AND DO NOT LIMIT RIGHTS THAT CANNOT BE WAIVED.
13. DISPUTE RESOLUTION AND ARBITRATION
Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, except to the extent mandatory consumer-protection law in your place of residence applies.
Informal Resolution: Before filing arbitration or a court action, the party raising a dispute must send a written notice describing the dispute and requested relief. The parties will attempt in good faith to resolve the dispute for at least 30 days. Notices to Sidao Tech, LLC must be sent to support@platethisai.com and the mailing address in Section 15.
Binding Arbitration: Except for an eligible individual action in small claims court or a request for temporary or preliminary injunctive relief to protect intellectual property or confidential information, any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Procedure: The arbitration will be conducted by one neutral arbitrator in English. Hearings may be conducted remotely where permitted. Filing fees and costs will be allocated under the AAA Consumer Arbitration Rules and applicable law. The arbitrator may award the same individual remedies available in court, but only to the extent necessary to resolve the individual claim.
Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION. IF THIS WAIVER IS FOUND UNENFORCEABLE FOR A PARTICULAR CLAIM OR REMEDY, THAT CLAIM OR REMEDY WILL BE SEVERED AND MAY PROCEED IN COURT AFTER ALL ARBITRABLE CLAIMS ARE COMPLETED.
Opt-Out Right: You may opt out of this arbitration agreement by sending a written notice to support@platethisai.com within 30 days after you first accept these Terms. Your notice must identify the account email or other account identifier and clearly state that you are opting out of arbitration. Opting out will not affect any other provision of these Terms.
14. APPLE APP STORE SPECIAL TERMS
If you use the App on an iOS device, you acknowledge that:
These Terms are between you and Sidao Tech, LLC only, not Apple.
Apple has no obligation to provide maintenance or support services for the App.
Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
